lawyers in the big cities bill more per hour than lawyers in small cities or towns. Will you be pleading guilty or do you plan to go to trial? Trial obviously adds money to the cost.

I’m kind of curious about this, since my dad was an LEO, and I was a public defender for a while, and then I was an LEO union lawyer. I’ve seen the system from a few different angles.

union lawyers are a necessary evil, they are the toilet plungers that move the oily bilge waste when it gets stuck or overflows.

I can see drug charges, property crimes, etc.

But I am talking about the real dirtbags. Serial rapists, repeat pedophiles, cold blooded killers. How do they do that,? with a victim and their family staring at them in the courtroom..getting off the guy that raped and murdered their child, etc.
I’m not saying the lawyers are bad, maybe just doing their job. But does their conscience ever bother them?

Well, the theory is that EVERYONE is entitled to the best possible legal representation they can get, but I, personally, couldn’t do it.

I was just wondering how defense lawyers win drunk driving cases, especially with a video, it is fairly easy to tell a drunk person from a not drunk person I think….

Well, the simplest reason is that DUI cases are pretty complex on the law enforcement end. There are a lot of steps of officer most perform to be in compliance with the federal training on the issue. If the officer misses a step, screws up the instructions (even a minor mistake, such as forgetting a word or two) can give a defense attorney room to attack.

Now, most state courts (and federal courts) have ruled as long as the officer is reasonably close in the instructions given and how the test is performed, then it should be good to go. But the problem is also prosecutors.

In cities under 100,000 (or even smaller counties), prosecutors may be only part time and work in private practice full time. So they might not have the time, energy or willpower to full research and prosecute a DUI case. They may have no clue what the defense attorney is talking about and aren’t able to get back the evidence a defense attorney chips away at.

Lastly, a lot of DUI cases are made by inexperienced officers, officers who don’t care much for DUIs or officers that don’t do a lot of DUIs. If an officer is on dayshift for the last 4 years, then works a nightshift and lands his first drunk in literally years…. He probably isn’t going to be spot on with his field sobriety tests.

So *shrugs* it is just the nature of the beast. When you have defense attorneys who don’t do anything except study the NFTSA manual on HGN and make a lot of money taking DUIs to court, you might see them win a lot of cases.

Now the good news….. In my experience, many cities have good officers and prosecutors that actually know their stuff and can win cases. So while it may seem like *a lot* of people get off the hook on their drunk driving charges, a lot more are successfully prosecuted.

I think if defense lawyers, who defend gang members and drug dealers, lived in the projects for at least 6 ms. they wouldn’t let these dangerous criminals back into the communities who: retaliate by killing, terrorize their communities, give a bad name to everyone in the their community, and (forcefully) retain children.

Maybe, just maybe if they remained in prison, if we got funding for preventative measures, if we had counselors in city schools….then students like 6 yr old Trinity from my class last year wouldn’t have been shot in a drive bye. Or 12 yr old Vando, a student of mine who was killed for refusing to join a gang.

The police do their job getting them off the streets, the defense lawyers put them back on the streets.
I agree. Everyone has the right to a defense lawyer, but I strongly believe that the lawyers should LIVE in these violent communities before they decide to make a decision of releasing them back in. I grew up in the ghetto and when lawyers do this, more ppl get killed and nothing gets done- which is why we don’t even bother to call the cops.

If the police actually did their jobs, the defense lawyers wouldn’t be able to get them back on the streets. Defense lawyers do what they do for everyone’s benefit. If you were in the wrong place at the wrong time and got railroaded by some overly ambitious cops, you’d want a defense attorney fighting for you the entire way and you’d also want every one of your civil liberties protecting you from their methods.

Why would Eric Holder and Barack Obama rush to provide US taxpayer paid defense lawyers to known terrorists?

its in the sixth amendment…. and it complies to not just citizens but "the accused".

"In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence."

Even jews, who aren’t ethnically white, refuse to become criminal justice defense lawyers (especially ones that work with the government). Do you know why whites excel in this field? Because they have absolutely no emotions, who is better to trust a job that requires apathy than a race of people that have mercilessly slaughtered billions of people including mostly women and children in the name of white supremacy? No real human being can put their heart into defending a child molester or murderer as a living.

So Johnnie Cochran was white, you say? Now that’s what I call a tan.
